Terms, Conditions and Cancellation Policy
Cancellations, Refunds, and or Transfer requests must be made in writing or in e-mail to reid@underthegui.com
All cancellations will be offered a full credit for the value of the order that can be used towards any other program, or a refund for the value of the order less 25%. Refunds will be issued to the purchasing credit card within 7 business days.
Requests for switching to a different class time or week of camp will incur no additional fee and will be granted provided there is room.
Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement:
To: Under the GUI Academy Inc. and the owners, directors, executives, employees, contractors, suppliers, participants, instructors, operators and staff in which UTG activities take place (all of whom hereinafter collectively referred to as the “Releasees”)
Assumption of Risks - UTG activities involve various risks, dangers and hazards which can result in sickness. Exposure to infectious disease including COVID-19 is one of the risks of participating in UTG camp activities. If you are a parent or guardian of a participant please educate your child on these risks, dangers and hazards before completing this form. All participants in UTG activities are required to assume all such risks, dangers and hazards and all injuries resulting therefrom.
Release of liability, waiver of claims and indemnity agreement (applies to person 19 years of age and older) in consideration of the Releasees allowing me to participate in UTG camps activities, I hereby agree as follows:
  1. To waive any and all claims that I have or may have in the future have against the Releasees and including death that I may suffer or that my next of kin may suffer as a result of my participation in UTG activities, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care, including any duty of care owed under the occupiers liability act r.s.b.c 1996, c. 337 on the part of the Releasees, I understand that negligence includes failure on the part of the releasees to take reasonable steps to safeguard or protect me from or warn me of the risks, dangers and hazards of participating in UTG activities;
  2. To hold harmless and indemnify the Releasees from any and all liability for any property damage or personal injury to any third party resulting from me or my family's participation in UTG activities;
  3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of death and incapacity;
  4. This Release Agreement any rights, duties, obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of British Columbia and no other jurisdiction, and;
  5. Any litigation involving the parties to this Release Agreement shall be brought solely within British Columbia and shall be within the exclusive jurisdiction of the Courts of British Columbia.
In entering into this Release Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of Under the GUI Academy Inc. activities, other than what is set forth in this Release Agreement.
I confirm that I have read and understand this Release Agreement and I am aware that by signing this Release Agreement I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators, assigns and representatives may have against the Releasees.
You will hold Under the GUI Academy harmless, are aware of the inherent risks of participating in these classes/camp programs. Your child is of suitable fitness level to participate and if you require more information about these risks of the programs, you will contact the person in charge of these programs.
In the event of an accident or injury, you give permissions and authorize Under the GUI Academy Camp staff to provide appropriate medical services or attention to my child. You understand that Under the GUI Academy does not carry or maintain health, medical, or disability insurance and I will cover any costs associated with health emergencies or injuries succumbed during classes or summer camps.
Should your child require such assistance during our camps, you give permissions to the Under the GUI Academy camp staff to apply any sunscreen that is necessary.
Under the GUI Academy reserves the rights to refuse to render class or camp services to any participant with or without reason or cause.
Media Release
Throughout the school year and camps, students, and student generated content may be highlighted in efforts to promote Under the GUI activities and achievements. For example, students may be featured in materials to increase public awareness of our school through newspapers, radio, TV, the web, DVDs, displays, brochures, newsletters and other types of media. It is important for us to know your wishes regarding division and media coverage of student achievements and events. If you do not wish to have media coverage of your child, please inform us immediately prior to the start of the school year or camp.
